These terms form the agreement between you and the seller of BackflowPass. Please read them before using the service or purchasing a subscription.

1. Who you are contracting with

BackflowPass is owned and operated by Aaron Whitfield ("we", "us", "our"), trading as BackflowPass. By creating an account, using the test report generator, or purchasing a subscription, you are entering into a contract with Aaron Whitfield. You can reach us at [email protected].

2. Acceptance of these terms

By accessing or continuing to use BackflowPass you agree to be bound by these terms. If you do not agree, stop using the service. If you use BackflowPass on behalf of a company or employer, you confirm you have authority to bind that organisation. If you are using it as an individual, you confirm you are of legal age to enter a contract.

3. What the service is

BackflowPass is a browser-based tool that helps certified backflow assembly testers record test readings, calculate pass/fail results from the readings entered, capture signatures, and generate a one-page PDF test report. It is a documentation and calculation aid only.

BackflowPass is an independent product. It is not certified, approved, accredited or endorsed by ASSE International, the USC Foundation for Cross-Connection Control and Hydraulic Research, or any water purveyor or state agency. Test procedures, pass/fail thresholds and accepted report forms vary by jurisdiction. You are solely responsible for confirming local requirements, for the accuracy of the readings you enter, and for every result you certify and submit.

4. Licence and account

  • We grant you a limited, non-exclusive, non-transferable right to use BackflowPass within the plan you have selected.
  • You must keep your account credentials confidential and are responsible for activity under your account.
  • You must provide accurate account and company information and keep it up to date.
  • You may not reverse engineer the service, resell or redistribute it, or circumvent plan limits or technical restrictions.
  • You retain ownership of the test data you enter. You grant us a limited licence to host and process that data solely to provide the service to you.

5. Acceptable use

You must not misuse BackflowPass. In particular, you must not:

  • use the service for any unlawful purpose, or to create false, fraudulent or misleading test records;
  • send spam, or use the service's email features to send unsolicited or deceptive messages;
  • infringe the intellectual property or privacy rights of any person;
  • interfere with the security or integrity of the service — no malware, probing, penetration testing without permission, scraping, or attempts to access other customers' data;
  • upload content you do not have the right to upload, including logos or customer information you are not authorised to use.

6. Intellectual property

We retain all ownership of BackflowPass and its intellectual property, including the software, report layouts, calculation logic, documentation and branding. Nothing in these terms transfers any of those rights to you.

7. Service level and warranties

We work to keep BackflowPass available and accurate, but we do not guarantee that the service will be uninterrupted, error-free, or free of data loss. Features may change over time. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Payment, subscriptions and refunds

Paid plans are billed in advance on the interval shown at checkout and renew automatically until cancelled. Prices are shown on our pricing page and may change with notice for future billing periods.

Payment, billing, invoicing, tax, currency, cancellation and refund mechanics are handled by Paddle and are governed by the Paddle Buyer Terms. Our own refund window is set out in our Refund Policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Suspension and termination

You may cancel your subscription at any time; access to paid features continues until the end of the paid period. We may suspend or terminate your access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. Where practical we will give notice first.

After termination you may export your test records for a reasonable period on request, after which cloud-stored data may be deleted. Records stored locally in your browser remain on your device.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the fees you paid in the twelve months before the claim. We are not liable for indirect, consequential or special damages, including lost profits, lost data, regulatory penalties, or loss of goodwill. Nothing in these terms excludes liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

You will indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.

11. General

  • These terms are governed by the laws of the seller's jurisdiction, and disputes will be heard by the competent courts there, unless applicable consumer law gives you the right to bring proceedings elsewhere.
  • You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
  • Neither party is liable for delays caused by events beyond their reasonable control.
  • If any provision is unenforceable, the remainder stays in force.
